General terms and conditions + travel conditions
1. Registration: Please register for your chosen offer using the online registration form. An early registration makes our work easier and guarantees you a free place. After receiving your registration you will receive a personal email confirmation. With the registration, these general terms and conditions become part of the contract between you and ROCKnSNOW Alpine Guiding Peter Bacher
2. Insurance: Each of our guides who work with us as a state-certified mountain guide, canyon guide, mountain bike guide, hiking guide or paraglider tandem pilot has comprehensive liability insurance. Otherwise, the participants are not insured by the organizer.
We therefore recommend that you take out adequate accident, rescue, foreign health, repatriation, liability, luggage and cancellation or travel cancellation insurance at your own expense.
2.1 Travel insurance is mandatory for our ROCK the WORLD trips. It is possible to book the European travel insurance with us. This contractual relationship comes about between the traveler and the insurance provider, not with ROCKnSNOW Alpine Guiding Peter Bacher. Any liability on the part of ROCKnSNOW Alpine Guiding Peter Bacher is therefore excluded.
3. Payment: All prices are adapted to the Zillertal and Austrian mountain guide tariffs. A person-related tariff applies to our tours. A higher price applies for one person and for 2 people (minimum tariff). From 3 people the person-related single price applies (group tariff).
All our prices are calculated fairly. Leading in the mountains is a demanding task with a lot of knowledge and experience behind it. That is why this service must have its fair price.
3.1 In the case of ROCK the WORLD package tours, down payments of customer monies are secured in accordance with the Travel Agency Security Ordinance (RSV), provided they are made eleven months before the end of the trip at the earliest. The remaining payments are to be paid 20 days before the start of the journey, during which the travel documents are sent to the traveler.
3.2. Price change before the start of the trip: In the package tour contract, the tour operator reserves the right to make price changes at the latest 20 days before the start of the trip after the package travel contract has been concluded. Permissible price changes are:
a; Costs for passenger transport as a result of fuel increases.
b; Taxes and duties to be paid for the contractually agreed travel services.
c; Exchange rate changes in the travel countries
4. Lack of requirements: Anyone who is physically fit or able to meet the requirements can take part in the events offered by ROCKnSNOW. The leader is entitled to exclude participants from the event if these obviously / recognizably do not meet the requirements. In this case there is no money back.
4.1 Before the ROCK the WORLD expeditions, we organize “get-to-know days” with the entire team at some time after the booked trip, where all expedition participants get to know each other. In the preparatory course, the participants are shown and trained in the necessary prerequisites.
5. Cancellation by the organizer before the start of the event: If too few participants take part in an offer or there are other circumstances (dangerous weather conditions, security, official measures or other force majeure) that prevent the offer from being carried out, the organizer can at short notice withdraw from the contract. If the customer does not want to or cannot rebook any of the alternative offers offered to him, he will of course be reimbursed for the payments made (minus the services already used). Further compensation claims are excluded.
5.1 Cancellation by the customer for a day tour: 48 hours before the start of the adventure booked can be canceled free of charge. After that, 100% of the total price is due.
5.2 Cancellation by the customer before the start of the ROCK the WORLD expeditions: Cancellation insurance is absolutely necessary for our exclusive travel destinations, as cancellation fees of 80% to 100% apply regardless of the time of cancellation. For the remaining expedition participants, these cancellation measures will not change anything in terms of price.
6. Program changes before the start of the event: Our offers take place regardless of the weather. We reserve the right to change the program for reasons such as bad weather, danger of avalanches, unfavorable conditions, safety. By accepting the general terms and conditions, the participants declare that they agree to this fact. Any additional costs will be charged to the participant or reduced costs will be reimbursed. No reduced costs will be reimbursed for changes to the program that are due to a lack of constitution, concentration and fitness of the participants.
7. Minimum number of participants: If the number of participants is insufficient, we are entitled to cancel the offer or to create another attractive offer for which several participants have already registered. If you do not want this new offer, we will of course reimburse you in full for the payments you have already made. If you still want the offer to be carried out, we will make you a newly calculated offer. If you agree to the newly calculated price, a new contract will be concluded.
7.1 If the minimum number of participants is not reached for ROCK the WORLD trips, we can withdraw without additional compensation, but no later than 20 days before the start of the package tour for trips of more than six days. The previously made payments for the package tour will of course be reimbursed.
8. Liability: The organizer is responsible for deficiencies in the implementation of the offers, provided that it is a failure of the agreed and to be provided services or changes that mean a reduction in value compared to the original agreement. This guarantee applies in any case only up to the amount of the agreed offer price and only for the direct damage. The organizer is not liable for disadvantages and damage of any kind if these were caused through no fault of the organizer or an auxiliary person of the organizer. The organizer assumes no liability for unauthorized participants and failure to follow the instructions! We want to expressly point out that every kind of movement in nature involves a certain residual risk. By booking your offer, you confirm that you are largely responsible and accept the residual risk.
Furthermore, the organizer assumes no liability in the event of disruptions in performance due to unavoidable and extraordinary circumstances caused, for example, by: wind and weather, snow conditions, avalanche danger, failure of mountain railways, natural disasters, etc.
8.1 We assume no liability for disruptions in the performance of brokered third-party services in day-to-day business and where ROCKnSNOW Alpine Guiding Peter Bacher acts as a travel agent. In the case of slight negligence, liability is excluded.
9. At ROCK the WORLD trips, each participant is responsible for passport, visa, customs, foreign exchange and health regulations at his own expense. For example, when booking a flight, the same first and last name must be given as it is in the passport. In the case of air travel, registration should be made no later than 8 weeks before the start of the journey.
10. Guarantee: Mountaineering is an outdoor activity and is therefore linked to the unpredictability of the forces of nature. As a result, we cannot guarantee success in the mountains. The mountain guide alone decides on the feasibility or the termination of a tour or an event for the benefit of the participants.
11. Rental equipment: Loss of or damage to rental equipment will be invoiced by ROCKnSNOW. This also applies to accidentally triggered avalanche airbag backpacks. The material that is made available by us is continuously checked by our guides to ensure that it is in perfect working order. ROCKnSNOW cannot be made liable for accidents due to undetectable defects in the material.
12. Organizer: is ROCKnSNOW Alpine Guiding Peter Bacher based in in Juns 521, A- 6293 Tux, Tyrol.
13. Applicable law and place of jurisdiction: The place of jurisdiction is Zell am Ziller. Austrian law is agreed so that the contract is subject to Austrian law by choice of law.
Terms and conditions for the implementation of Hike & Fly tours
1. These terms and conditions apply to all Hike & Fly tours organized by Peter Bacher, the owner of ROCKnSNOW Alpine Guiding, hereinafter referred to as ROCKnSNOW Alpine Guiding. These are guided mountain tours in which the descent is carried out by flying a paraglider.
2. The ROCKnSNOW Alpine Guiding offers the following as part of the Hike & Fly tours Services to: - guided mountain tour - Discussion of any flight to be carried out including a recommendation of route planning (Departure mountain, take-off site, flight route and landing site) - Obtaining weather information - Flight briefing - if possible, paragliding in a convoy ATTENTION: This is not paragliding training!
3. Requirements for participants: - The participant must be in possession of an Austrian paragliding license with overland authorization or a German B-license or another equivalent authorization that authorizes him to lead a paraglider in Austria. - The participant must be able to independently lead a paraglider in high alpine terrain, especially as he must be able to safely take off, thermal flying and landing even on small landing sites. - The participant must bring his own mountaineering umbrella including airbag harness (recommended weight no more than 7 kg), helmet, whereby the flight equipment must be approved for use in Austria or be suitable for air travel and must have upright insurance, as well as mountain boots. Snowblades and telescopic sticks can be borrowed if necessary. It is expressly pointed out that the Fly & Hike or Hike & Fly Tour in question is not a paragliding training, but only fully trained and experienced paragliding pilots are allowed to take part in it.
4. Even though a Fly & Hike Tour is generally a safe matter and the mountain guides do their best to carry out the event safely, even with the greatest care and optimal progress, especially with a paraglider flight, for example when starting or landing, Incorrect landing, occurrence or falls, accidents with not inconsiderable consequences of injuries (e.g. sprains, broken bones, spinal injuries, concussions, etc.) happen. This is a generally known risk that accidents can happen when paragliding, for example due to wind-related influence, and in extreme cases it can also lead to a fall with the associated danger to life.
The participant is aware of this risk and will therefore independently check whether the recommended take-off and landing site, the flight route and also the weather are suitable for the execution of the flight and will only carry out the flight independently if he meets the conditions for the execution has considered the flight to be suitable for himself. ROCKnSNOW Alpine Guiding, or every employee of ROCKnSNOW Alpine Guiding, is liable to pay compensation for property damage only if this was caused by an act or omission by the employee with intent or gross negligence. In any case, liability does not exist if the ROCKnSNOW Alpine Guiding and its people have taken all necessary measures to prevent the damage or if these measures could not be taken. The organizer's liability for property damage is limited to intent or gross negligence. Exclusions or limitations of liability apply mutatis mutandis in favor of the employees and authorized representatives of RocknSnow Alpine Guiding. There is no claim for compensation or reimbursement of the fee for the tour if the planned tour, flight route, flight time, planned take-off and landing sites, in particular for security, weather or other valid reasons, have been changed.
5. No liability is assumed for damage resulting from compliance with applicable legal and flight regulations, official regulations or instructions, or from contributory negligence on the part of the participant. The participant confirms that he is in good physical and mental condition.
6. No employee or agent of ROCKnSNOW Alpine Guiding is entitled to add, modify or cancel provisions of this agreement. Should one of the provisions of this contract be invalid, this shall not affect the validity of the remaining provisions.
7. Austrian law applies exclusively to all disputes arising from this agreement. The exclusive place of jurisdiction is the district or regional court responsible for 6293 Tux.
ROCKnSNOW Alpine Guiding, Peter Bacher
I confirm that I have read the above text in detail, that I have the physical and mental requirements, as well as an approved, airworthy flight equipment including insurance and that I only undertake a flight after independently assessing the local conditions (take-off and landing place, weather) and judged them to be safe.
Terms and conditions for the implementation of paraboarding / paraskiing tours
1. These terms and conditions apply to all paraboarding / paraskiing tours organized by Peter Bacher the owner of ROCKnSNOW Alpine Guiding, hereinafter referred to as ROCKnSNOW Alpine Guiding. In such a paraboarding / paraskiing tour, a mountaineer paraglider approaches a mountain from a high take-off point, which is reached by lift or as part of a mountain tour, gliding or (if possible) using thermal updrafts with a cross-country flight The slopes can then be skied on a snowboard or skis. If the height is sufficient, the par-glider starts again and tries to fly to a new mountain in order to descend it again with the snowboard or skis.
2. The ROCKnSNOW Alpine Guiding offers the following services as part of the paraboarding / paraskiing tours: - guided mountain tour - Discussion of any flight to be carried out including a recommendation of route planning (Departure mountain, take-off site, flight route and landing site) - Obtaining weather information - Assessment of the snow profile - Flight briefing - if possible, paragliding in a convoy ATTENTION: This is not paragliding training!
3. Requirements for participants: - Possession of an Austrian paragliding license with overland authorization or a German B-license or another equivalent authorization certificate that authorizes him to drive a paraglider in Austria. - He must be a very experienced paraglider pilot who is able to independently lead a paraglider in high alpine terrain, such as how to safely master a reverse take-off, thermal flying and landing even on small landing sites, top and slope landings. - He must have his own mountaineering umbrella including an airbag harness (recommended weight no more than 7 kg), helmet, whereby the flight equipment must be approved for use in Austria and must be airworthy and must have upright insurance. - You must also bring appropriate snowboard or ski equipment (freeride skis with a width between 100-130 mm under the binding with front or double rocker and freeride ascent binding and skins; or splitboard with skins, which can also be hired if necessary including safety equipment, consisting of avalanche transceiver, probe and shovel (can be borrowed if required). - Furthermore, he must be able to snowboard and / or ski safely in alpine terrain. It is expressly pointed out that the paraboarding / paraskiing tour in question is not a paragliding training, but only fully trained and very experienced paragliding pilots are allowed to take part.

Likewise, he will only undertake a descent with a snowboard or ski on his own responsibility if, in his opinion, the terrain, the snow conditions and his ability allow a safe descent.
ROCKnSNOW Alpine Guiding, or every employee of ROCKnSNOW Alpine Guiding, is liable to pay compensation for property damage only if this was caused by an act or omission by the employee with intent or gross negligence.
